I have used a Legal Nurse Consultant for years to build the chronology in my personal injury and workers’ compensation cases. I prefer an LNC for this task as their knowledge and experience in the healthcare field lends special insight that guarantees I am getting all the relevant facts, accurately and efficiently. The chronology tells the story of my client’s injury and ensuing care in such a way that I can literally cut/paste the words into a demand letter. A section of the chronology alerts me to missing provider records. But most importantly, the LNC performs a bill audit that captures all relevant costs associated with the care rendered as a result of the injury. Beyond saving time and money, it actually makes money as I can be confident that my demand amount accurately reflects all related costs.

I use Legal Nurse Consultants ‘right out of the gate’, specifically by way of the initial interview with a potential client. Nurses have the knowledge and training to conduct an interview in such a way as to get to the heart of what may – or may not – have happened in a particular scenario. As attorneys, we understand that our client’s perception of an event may be incomplete. The nurses have the healthcare experience and ‘6th sense’ to glean the relevant medical information, facts that even the client did not realize were significant. Taking it one step further, the LNC is able to advise me on the ‘bare bones’ records to acquire to get to the heart of the story. Bottom line – that saves me time and money!

Using a Legal Nurse Consultant to initially screen a case for merit is the most economically efficient means of acquiring that first glimpse into the records and understanding as to the existence – or absence – of breach of duty and causation. Nurses are inherently detail-oriented professionals with a knowledge and experiential base that makes them the logical first choice for this task. Furthermore, by using an LNC I am assured that their inside knowledge and understanding will capture the details most relevant to the integrity of the case. I use the information in their report to assist me in moving forward with the confidence to intelligently discuss the issues with doctors and clients.

I began using a Legal Nurse Consultant for the ‘usual’ work products – review for merit, chronologies, working with experts, etc. I quickly realized, having an in-house LNC, that nurses are natural teachers. It seemed logical to capitalize on that strength, so I began using my LNC as the healthcare education component in the mediation process. She coordinated the medical pieces, i.e., medical demonstrative, ‘Day-in-the-Life’ video, Life Care Planning services, etc., and incorporated them into my Power Point presentations for mediation. On one occasion, her presence at the mediation was integral to counter defense arguments regarding specific facts / statements in the medical record. There is no question that the very favorable outcome in a large trucking accident case was due, in part, to input from my LNC.

When I first received the medical records to be reviewed for a particular case I had estimated that it would take 8-10 hours to complete my review. However, working with a Legal Nurse Consultant, I completed my task in only 3 hours. This expedited process occurred for several reasons. First, our pre-review teleconference provided me with a solid sense of the issues of concern. Second, the massive volumes of medical records were meticulously separated and ordered which allowed me to avoid getting stuck in the search process. Finally, our post-review teleconference was very instructive as I appreciated her clinical expertise in both the nursing and medical areas of concern in this case. I am always extremely concerned about the economic cost of my consultant services, particularly in regards to the strained resources of most nursing home plaintiffs and their families. With the Legal Nurse Consultant's assistance and leg work I was able to complete my review and have a cogent discussion in the shortest time possible.
